WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK & INDEMNITY AGREEMENT (ONTARIO) PLEASE READ CAREFULLY – THIS AFFECTS YOUR LEGAL RIGHTS In consideration of being permitted to participate in any way in activities, classes, training, events, or programs offered by Legacy X Jiu-Jitsu (the "Academy"), and/or being permitted to enter any restricted area of the facility, the undersigned agrees as follows: 1. INSPECTION & PARTICIPATION I acknowledge that I (or my child, if applicable) will inspect the facilities and equipment prior to participation. If anything appears unsafe, I will immediately notify an instructor or staff member and refuse to participate. 2. ASSUMPTION OF RISK I fully understand and acknowledge that: • Brazilian Jiu-Jitsu and related activities involve inherent risks, including but not limited to serious injury, disability, paralysis, or death. • These risks may arise from my own actions, the actions of others, or the condition of the premises or equipment. • Injuries may occur due to physical contact, falls, submissions, or accidental collisions. • There may be risks that are not known or not reasonably foreseeable at this time. I voluntarily accept and assume all such risks, whether known or unknown. 3. RELEASE OF LIABILITY I hereby release, waive, and discharge Legacy X Jiu-Jitsu, its owners, instructors, employees, contractors, volunteers, affiliates, and facility operators (collectively referred to as the "Releasees") from any and all liability for any injury, loss, or damage, including death, that may arise from participation in Academy activities, even if caused by negligence, to the fullest extent permitted under the laws of the Province of Ontario. 4. INDEMNIFICATION I agree to indemnify and hold harmless the Releasees from any claims, demands, or legal actions brought by me or on my behalf, or by any third party, arising out of my participation in Academy activities. 5. MEDICAL CONSENT I consent to receive emergency medical treatment if necessary. I understand that I am responsible for any medical costs incurred. 6. HEALTH & SAFETY I confirm that: • I am physically able to participate in training. • I will not train while sick or with any contagious condition (including skin infections). • I will inform instructors of any injuries or medical concerns prior to training. 7. PHOTOGRAPHY & MEDIA RELEASE I grant permission for Legacy X Jiu-Jitsu to use photographs or videos of me (or my child) taken during training for promotional purposes, without compensation. 8. MINORS (IF APPLICABLE) If signing on behalf of a minor, I certify that I am the parent or legal guardian and agree to all terms on their behalf. I accept full responsibility for the minor's participation. 9. GOVERNING LAW This agreement shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein. 10. SEVERABILITY If any portion of this agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. ACKNOWLEDGEMENT I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY, FULLY UNDERSTAND ITS TERMS, AND UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS BY SIGNING IT. I SIGN THIS AGREEMENT FREELY AND VOLUNTARILY.
